Under AS 25.05.261, many people can legally perform a wedding in Alaska. This includes ministers and religious leaders, judicial officers, elected public officials, and individuals appointed as marriage commissioners by a local court. A friend or family member can officiate if they first receive that appointment from the court nearest to where the ceremony will take place. The appointment requires both parties' names and the date and place of the ceremony, and costs $25 to process.

After the ceremony is done, the signed license must be returned to a HAVRS office within seven days. The officiant, both spouses, and the witness all sign the license. Once it is returned and registered, the couple can order a Certificate of Marriage for $30.

Historical Ketchikan Gateway Marriage Records

The Ketchikan area has one of the longer historical records among Alaska boroughs. Ketchikan marriage records date back to 1901 in the Alaska State Archives collection, and the SSA records show formal state registration in Ketchikan going back to 1913. That makes it one of the earliest communities in Alaska with a continuous documented record of marriages. The Craig area also has records dating to 1910, and Hyder marriage records cover the period from 1920 to 1957. All of these are available through the Alaska State Archives collection on FamilySearch.

The Alaska Vital Records collection at FamilySearch covers marriages statewide from 1816 through 1959. Researchers can search these collections online for free. The collection was built from the Alaska State Archives' holdings, with over 1.1 million documents scanned and indexed through the FamilySearch partnership. Browsing the index and viewing images does not require a subscription.

The Genealogical Society of Southeastern Alaska is based in Ketchikan and may be able to assist with local research. They focus on the southeastern Alaska region and may have access to local indexes and materials not yet available online. For pre-statehood records not found through FamilySearch, the Alaska State Archives genealogy page explains how to request research assistance from archivists.

Marriage Laws in Ketchikan Gateway Borough

All marriages in Ketchikan Gateway Borough are governed by Alaska law under Title 25 of the Alaska Statutes. Under AS 25.05.021, a marriage is void if either party has a spouse living at the time of the new marriage, or if the two parties are more closely related than first cousins. These conditions make the marriage void from the start, not just voidable.

Both parties must be 18 or older to marry without additional steps. Persons 16 or 17 years old must provide a court order and written consent from both parents or guardians. Under AS 25.05.171, no one younger than 16 may marry in Alaska. When age is in question, a birth certificate may be required with the application.

Alaska has no common law marriage. A license must be obtained, a ceremony must be performed, and the signed license must be returned to a HAVRS office within seven days. All three steps are required. The ceremony itself has no required script. Under AS 25.05.301, both parties must clearly declare in front of the officiant and at least one witness that they are marrying each other. The witness must be 18 or older and competent to understand the seriousness of the ceremony.

Previous marriages must be listed on the application with start and end dates. A copy of a recent divorce decree (finalized within 60 days) must be attached. All prior marriages must be legally ended before a new license is valid.
